Changes impact motorists

PENDLETON — Motorists in Pendleton might want to take note of two ordinance amendments passed at the Jan. 10 council meeting: One involves parking, and the other involves speed limits.

A change to the town’s parking ordinance makes it illegal to park on any part of a sidewalk, the area between a street and a sidewalk, and on “any lawn or green space” within town, except when a vehicle is being loaded, unloaded or washed.

“The driving force” behind the ordinance is ensuring people can use the sidewalks, councilman Bob Jones said.

He and council President Jessica Smith said there has been an issue in the past of people parking across sidewalks, interrupting their use.

Jones said not parking on lawns and other green spaces is also a matter of being “fair to your neighbors” and keeping properties looking nice.

The amendment allows for temporary parking on lawns for loading and unloading, and for washing vehicles.

The changes also clarify that there is no parking along Falls Park Drive east of Pendleton Avenue in town, except in marked parking spaces.

The main change to the town ordinance governing speed limits simplifies the times when school zone speed limits are in effect.

The amendment states a 20 mph limit applies from 7 a.m. to 7 p.m. on school days.

Smith said previously there were multiple times during the day when school zone speed limits were in effect.

“This amendment makes it cleaner,” Smith said.

The 20 mph limit will apply “within the immediate vicinity of a school,” new language that aligns with state law and won’t have to be changed if the school district grows, town attorney Alex Intermill said previously.

“If a new school is built, it will capture that,” Intermill said.

Town manager Tim McClintick said the town worked with South Madison school representatives and Pendleton Police Chief Marc Farrer on the changes.

Both amendments will take effect after they are advertised, Intermill said Jan. 10, after the council voted 5-0 to approve them.

The town plans to install appropriate signage to alert motorists to the changes.

According to a schedule at pendletontowncourt.org, the fine for speeding in a school zone is $180 plus six points on a person’s driving record. The fine for parking where prohibited is $30 (not including handicap spaces, and areas blocking fire hydrants, fire lanes and crosswalks, which carry higher fines.) If violations are contested and the violation holds, court costs also apply ($130 in most cases).

Board of Zoning Appeals

The Board of Zoning Appeals (BZA) decides requests for variances from the standards identified in the town’s Unified Development Ordinance. The BZA also makes final decisions on conditional use requests and appeals of administrative decisions.

The BZA consists of five members appointed by the town council and plan commission. The board meets at 7 p.m. on the third Tuesday of each month at Pendleton Town Hall, 100 W. State St.

Historic Preservation Commission

The Historic Preservation Commission establishes historic districts and reviews certificates of appropriateness for development and alterations within the downtown business district.

The commission consists of six members appointed by the town council president and Historic Fall Creek, Pendleton Settlement. The commission meets at 7 p.m. on the second Tuesday of each month in Pendleton Town Hall, 100 W. State St.

Parks and Recreation Board

Parks and Recreation Board exercises the general supervision and makes the rules of the parks department. The board prepares and submits an annual budget to the town council, makes recommendations and an annual report to the town council concerning the operation of the board and status of park and recreation programs in the district.

The board consists of seven members appointed by the town council, Pendleton Community Public Library Board, South Madison Community School Corp. Board and the Madison County Circuit Court judge. Board meetings take place at 6 p.m. on the second Wednesday each month at the Falls Park Office, 460 Falls Park Drive.

Plan Commission

The plan commission reviews subdivisions of land, site development plans and planned unit developments (PUDs), in addition to initiating amendments to the zoning code and map.

The plan commission consists of seven members appointed by the town council and meets at 7 p.m. on the second Wednesday of each month at Pendleton Town Hall, 100 W. State St.

• Brad Balentine, to replace Brian Souders, whose term expired Dec. 31; town council president appointee

• Connie Shultz-Heinz, to complete the term of Matthew Roberts, who resigned after being sworn in as Pendleton clerk-treasurer; town council president appointment

Redevelopment Authority

The Redevelopment Authority was created as an instrument of the town to finance local public improvements for lease to the Pendleton Redevelopment Commission. The Redevelopment Authority consists of three members appointed by the town council. Redevelopment Authority meetings take place at 7 p.m. on the fourth Wednesday of each month at Pendleton Town Hall, 100 W. State St.

Redeveloment Commission

The redevelopment commission oversees the town’s Tax Increment Financing (TIF) districts and Falls Pointe Business Park.

The redevelopment commission consists of six members appointed by the town council and the South Madison Community School Corp. Board. Commission meetings take place on the fourth Thursday of each month at Pendleton Town Hall, 100 W. State St.

Urban Forestry Committee

The committee is responsible for administering a written plan for the care of trees and shrubs along streets and in other public areas.

Utility Rate Advisory Board
