Frankton man arrested after scuffle at Lapel residence

LAPEL — An early Saturday morning incident in Lapel ended in the eventual arrest of a Frankton man on felony charges involving a gun.

According to Lapel Police Department, officer Blake Montgomery responded to a call at 2:30 a.m. May 16 about suspicious activity at 529 Walnut St., Lapel.

Dylan Canter, 20, of Lapel and Jobe O’Bryant, 20, of Frankton were involved in a verbal altercation, an LPD press release states. O’Bryant left the residence and returned 20 to 30 minutes later with a gun, the release states.

Upon return, witnesses said a second argument occurred, and O’Bryant pointed a gun at Canter, who along with others tried to gain control of the weapon from O’Bryant, the release states.

During the scuffle, the weapon discharged and hit a nearby cooler. Also during the struggle, according to the LPD, O’Bryant hit Thompson Shuck, 24, of Lapel, in the mouth.

Several agencies were unsuccessful in finding O’Bryant that morning, the release states. At 3:47 p.m. Sunday, May 17, O’Bryant turned himself in at Anderson Police Department.

Montgomery later transported O’Bryant to Madison County Jail, where he was booked on a Level 6 felony charge of pointing a firearm; a Level 5 felony charge of criminal recklessness while armed with a deadly weapon; and a Class A misdemeanor charge of battery causing bodily injury.

Lapel Police Chief Kelly Naselroad said the LPD served search warrants on Sunday at O’Bryant’s home in Frankton, looking for the suspect and evidence. A family member said O’Bryant had gone to the Anderson Police Department to turn himself in, Naselroad said. A search failed to locate a gun.

At the station in Anderson, O’Bryant refused to talk without the presence of a lawyer, the report states.

According to the LPD, the incident is under investigation, and the case and charging recommendations have been turned over to the Madison County Prosecutor’s Office.
